After much anticipation by the elder law community, the new Illinois Power of Attorney Act will take effect on July 1, 2011. This new law was specifically designed to provide better protection against agents who use powers of attorney to financially and physically abuse vulnerable people. Originally an initiative of the Illinois State Bar Association Elder Law Section and a reaction to many egregious cases of elder abuse and financial exploitation, the new Power of Attorney Act is intended to give the community greater recourse and stronger remedies to combat bad agents.
